Federal Judge Blocks Disney, Fox, Warner Bros. Discovery Sports Streaming Venture, Boosting Fubo
In a significant development for the sports streaming industry, a federal judge has temporarily blocked the launch of Venu Sports, a new joint venture between Warner Bros. Discovery, Disney, and Fox Corporation. This decision represents a major setback for the ambitious streaming service, which was poised to revolutionize how sports content is delivered to viewers.
The ruling came in response to a lawsuit filed by Fubo, a competing sports streaming service. Fubo had requested a preliminary injunction to prevent the launch of Venu Sports, arguing that the venture would unfairly reduce competition in the sports streaming market. With the NFL season just around the corner, the timing of this legal action is crucial.
U.S. District Judge Margaret Garnett’s preliminary injunction order highlighted concerns that the joint venture could significantly hinder competition and restrict trade. The judge’s ruling suggests that Fubo’s claims about potential market distortion have substantial merit.
Fubo’s legal challenge, initiated in February, asserts that the collaboration between these media giants could monopolize sports media rights, creating a restrictive bundle that edges out other competitors. In response, Disney, Fox, and Warner Bros. Discovery announced plans to appeal the court’s decision. They argue that Venu Sports is a competitive force designed to enhance consumer choice by offering a fresh alternative in the streaming market.
Priced at $42.99 per month, Venu Sports was set to provide access to a wide range of sporting events, including NFL, NBA, MLB, NHL, tennis, soccer, golf, NASCAR, and UFC. The service aimed to cater to cord-cutters by aggregating content from the three media companies into one platform.
The news of the court’s decision led to a notable increase in Fubo’s stock, which surged over 17% on Friday. Fubo co-founder and CEO David Gandler hailed the ruling as a victory for both his company and consumers. He emphasized that this legal outcome would contribute to a more competitive sports streaming market.
